1. Acceptance of Terms
By accessing or using the FXAP website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.
2. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
3. Purchases and Payments
We use Stripe, a third-party payment processor, to handle all payment transactions. By making a purchase, you agree to be bound by Stripe's Services Agreement, available on their website.
All sales are final. We do not offer refunds for digital products once they have been purchased and access has been granted, unless otherwise required by law.
4. Use of Software
The software and files available for download on this Service are the property of "BrickShot". You are granted a limited, non-exclusive, non-transferable license to use the software for your personal, non-commercial use.
You agree not to decompile, reverse engineer, or otherwise attempt to discover the source code of the software. You may not redistribute, sell, or sublicense the software without express written permission.
5. User Conduct and Reviews
You may post reviews for products you have purchased. You agree not to post any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
We reserve the right to remove any content or review that we deem, in our sole discretion, to violate these Terms, without notice to you.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of Liability
In no event shall FXAP, "BrickShot", or "Evo Hosting" be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
